1. Agreement to Terms

By engaging Multitrade Services Group Pty Ltd ("MTS Group", "we", "us", or "our") — ABN 22 674 437 935 — for any renovation or maintenance services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not engage our services. These terms apply to all projects including home renovations, commercial refurbishment, facilities maintenance, educational facility maintenance and lawns and grounds maintenance.

2. Services

MTS Group provides multi-trade building, renovation and maintenance services, including but not limited to:

  • Bathroom, kitchen and laundry renovations
  • Full home renovations and refurbishments
  • Commercial fit-outs and refurbishment
  • Facilities and property maintenance
  • Educational facility upgrades and maintenance
  • Lawns and grounds maintenance
  • Plastering, painting, tiling and waterproofing
  • Joinery, cabinetry and carpentry
  • Heritage property restoration and renovation

Services are provided primarily across Lake Macquarie, Newcastle, the Hunter Region and the Central Coast, NSW, Australia. We may accept projects in other locations at our discretion.

3. Quotes and Pricing

All quotes provided by MTS Group are prepared following a site assessment and are provided in writing with a detailed breakdown of costs. Quotes are:

  • Free and obligation-free
  • Valid for 30 days from the date of issue, unless otherwise stated
  • Based on the scope of work and information available at the time of quoting

Final pricing may vary from the quoted amount if:

  • The scope of work changes from what was originally agreed
  • Hidden defects, structural issues or other conditions are discovered during the course of works that were not visible or known at quoting
  • Material costs change significantly between quote acceptance and commencement
  • Access conditions differ materially from what was described or observed

We will always discuss any variation to the quoted price with you before proceeding with additional or varied work. No additional costs will be incurred without your knowledge and agreement.

4. Deposits and Payment Terms

Payment terms are as follows:

  • For renovation projects, a deposit of up to 10% of the quoted amount may be required before work commences, to secure materials and scheduling
  • Progress payments may be required at agreed milestones for larger projects
  • Final payment is due upon practical completion of the works, unless otherwise agreed in writing
  • We accept bank transfer (EFT) and payment by arrangement — payment method will be specified on your invoice
  • Outstanding invoices are due within 14 days of issue
  • Late payments may attract interest at a rate consistent with applicable law

For commercial facilities maintenance contracts, payment terms will be specified in the individual contract agreement.

5. Scheduling, Access and Site Conditions

By engaging MTS Group, you agree to:

  • Provide reasonable and safe access to the work area at agreed times
  • Ensure the work area is free from hazards prior to commencement
  • Notify us in writing of any known hazards, asbestos, heritage restrictions, or special site conditions prior to commencement
  • Ensure required approvals (Development Approval, CDC, Heritage consent) are obtained before work requiring such approvals commences
  • Provide at least 48 hours notice (where practicable) if you need to reschedule or restrict access
  • Ensure that pets, children and third parties are kept away from active work areas during construction

6. Workmanship Warranty

MTS Group offers a 10-year warranty on all workmanship. The terms of this warranty are:

  • The warranty covers defects in workmanship — that is, failures attributable to how the work was performed
  • We will rectify any confirmed defect in workmanship at no additional cost during the warranty period
  • The warranty does not cover damage caused by misuse, alterations made by third parties after completion, normal wear and tear, or damage from events outside our control (storms, flooding, etc.)
  • All fixtures, fittings, appliances and products carry their individual manufacturers' warranties, which are separate from our workmanship warranty
  • Warranty claims should be reported in writing to mtsgroup@mail.com as soon as a defect is discovered

7. Licences and Insurance

MTS Group holds all required contractor licences for the renovation and maintenance work we undertake in NSW. We carry:

  • Public liability insurance
  • Workers compensation insurance (for our employed team members)
  • Contractor all-risks insurance for relevant project types

Evidence of current insurance coverage is available upon request. For home renovation projects above the relevant Home Building Act threshold, we comply with the NSW Home Building Act 1989 requirements including mandatory home warranty insurance where applicable.

8. Cancellation and Rescheduling

We understand that circumstances change. Our cancellation policy is:

  • Cancellation more than 5 business days before commencement: Deposit refunded minus any materials already ordered or costs incurred
  • Cancellation within 5 business days of commencement: Deposit may be forfeited to cover scheduling costs and materials
  • For ongoing maintenance contracts, the cancellation terms specified in the individual contract apply

We will always work with you to find a fair solution in exceptional circumstances. We do not wish to profit from genuine hardship.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • MTS Group's liability in respect of any project is limited to the total value of the contract for that project
  • We are not liable for pre-existing defects or conditions that were not known to us at the time of quoting
  • We are not liable for damage caused by third parties, acts of nature, or events beyond our reasonable control
  • We are not liable for consequential, indirect or special losses including loss of income, business interruption or loss of amenity, except where such liability cannot be excluded by law

Nothing in these terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.

10. Variations

Any changes to the agreed scope of work (variations) must be agreed in writing between MTS Group and the client before the varied work is carried out. A written variation order will specify the additional or changed work and the adjusted price. Verbal variations are not binding on either party.

11. Intellectual Property

Any designs, plans, drawings or specifications prepared by MTS Group remain the intellectual property of MTS Group until full payment has been received, at which point ownership transfers to the client. Photos of completed projects may be used by MTS Group for portfolio and marketing purposes unless you expressly request otherwise in writing.

12. Dispute Resolution

If you have a concern or dispute about our services:

  • Please contact us first — call 0452 563 787 or email mtsgroup@mail.com — and we will work with you to resolve the issue fairly and promptly
  • If we are unable to resolve the dispute directly, we may agree to use an independent mediator or refer the matter to NSW Fair Trading's building dispute resolution service
  • For home building disputes, the NSW Civil and Administrative Tribunal (NCAT) may have jurisdiction depending on the nature and value of the claim
  • These terms are governed by the laws of New South Wales, Australia

13. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Any updated terms will be posted on this page with a revised date. For ongoing projects, the terms in place at the time of contract execution apply unless we agree otherwise in writing.
